Terms of Service

These Terms of Service ("Terms") are an agreement between you and Optimal Craps, run by Steve Nold as a sole proprietor ("we," "us"). They apply to our information site at optimalcraps.com and our simulator web app at sim.optimalcraps.com (together, the "Service"). By buying a seat or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
1. Who the Service is for. Optimal Craps is customized craps analysis and simulation software intended for dice influencers who have a verified in-casino edge. It is not intended for random rollers.
2. No gambling on the Service. No betting or gambling takes place on the Service, and we do not accept wagers. You are responsible for complying with the gambling laws where you live and play.
3. Not financial or gambling advice. The simulator models possible outcomes. It does not guarantee any results, and nothing in the Service is financial or gambling advice. Any decisions you make at the table, and their results, are your own responsibility.
4. Purchase, payment, and refunds. A single-user seat (login) to the simulator is a one-time purchase at the price shown at checkout, plus applicable tax. Payments are processed through Stripe's Managed Payments, with Link (a Stripe affiliate) as the merchant of record (reseller). Link handles checkout, payment details, sales tax/VAT, receipts, refunds, and disputes, and your card statement will show LINK.COM* OPTMLCRAPS.
All sales are final. Because you get immediate access to the software, we do not offer refunds, except where the law or Link's terms as merchant of record require one.
5. Your license. When you buy a seat, we give you a personal, non-exclusive, non-transferable license to access and use the simulator for as long as we offer the Service, unless your license is revoked as described in section 12. Your seat is for you alone. You may not share, sell, or transfer your login.
6. Account security. Your email address is your username. Keep your password confidential and let us know right away at info@optimalcraps.com if you think someone else has used your account. You are responsible for activity under your account.

8. Intellectual property. The Service, including the software, simulations, content, and the Optimal Craps name, belongs to Optimal Craps. These Terms don't give you any ownership rights, only the license described above. You may use the results and Excel downloads you generate for your own personal use.
9. Availability and changes to the Service. We work to keep the Service running, but we don't promise it will always be available or error-free. We may update, change, or stop offering features, or the Service itself, at any time.
10. Disclaimer of warranties. The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent allowed by law.
11. Limitation of liability. To the fullest extent allowed by law, Optimal Craps will not be liable for any indirect, incidental, special, or consequential damages, or for any gambling losses or lost profits, arising from your use of the Service. Our total liability for any claim related to the Service is limited to the amount you paid us for it.
12. Suspension and revocation. We may suspend or revoke your license and access at any time, at our sole discretion and without a refund.
This includes when we suspect your login is being shared, for example when sign-in activity shows suspicious, multiple, or widely separated IP addresses.
13. Kindle book. Our Kindle book is sold through Amazon, and Amazon's terms govern that purchase.
14. Changes to these Terms. We may update these Terms from time to time. When we do, we will post the new version on the Service and update the effective date above. If you keep using the Service after a change, you accept the updated Terms.
15. Governing law. These Terms are governed by the laws of Washington State.
